General Terms and Conditions
These General Terms and Conditions apply to all purchases made through the Amelia & Rose Boston website. By placing an order, you agree to these terms in full.
1. Applicability
These conditions apply to all agreements between JDA-Commerce (KvK registration number: 96049308), operating under the name Amelia & Rose Boston, and the customer. By completing a purchase, the customer confirms that they have read and accepted these terms in their entirety.
2. Product Information and Disclaimer
We reserve the right to correct any typographical or printing errors on the website.

Colors: Product images are for illustrative purposes. Colors may differ slightly due to screen settings and lighting. This is not considered a defect.

Sizes: As products are measured manually, dimensions may differ by approximately 1–3 cm from the size chart. This is an industry standard and does not constitute grounds for a complaint. We recommend choosing a larger size if you are uncertain.
3. Ordering and Pricing
Orders are binding once payment has been completed. All prices are stated including VAT (where applicable) but excluding shipping and import fees unless otherwise specified.
4. Delivery and Force Majeure
We are not liable for delays caused by circumstances beyond our control (Force Majeure), such as war, natural disasters, pandemics, strikes, or transport disruptions. Under such circumstances, delivery times will be extended, and no compensation will be provided.
5. Complaint Handling and Disputes (Crucial)
To protect both the buyer and the seller, the following process applies strictly:

Contact Requirement: Before initiating a dispute with a third party (e.g., Klarna or PayPal), the customer must contact our customer service and allow us reasonable time to resolve the issue.

Investigation Period: For complaints regarding missing packages or product defects, we reserve the right to an investigation period of up to 30 days (e.g., to initiate tracking with the shipping company). No refunds will be issued during this investigation period.

Evidence Requirements: The customer must provide clear photos of any defects, as well as a photo of the package label, for a complaint to be processed.

Chargebacks: If a dispute is opened unjustifiably while the delivery is still within the timeframe of our terms (including Force Majeure), or if the item is marked as delivered according to tracking, we will contest the dispute and charge the customer for administrative costs.
6. Intellectual Property
All content on this website (text, images, logos, design) belongs to Amelia & Rose Boston and may not be copied or used without written permission.
7. Liability
Amelia & Rose Boston is not liable for indirect or consequential damages arising from the use of our products or services, beyond what is prescribed by mandatory law.
8. Applicable Law
These terms are governed by and interpreted in accordance with Dutch law. Disputes shall primarily be resolved through mutual agreement with our customer service.
